This article aims to explore judicial recovery from the creditor’s perspective, with a particular focus on banking contracts secured by fiduciary alienation, which qualifies as extra-bankruptcy credit. It examines the primary economic and procedural impacts, while also raising critical considerations about aspects that tend to undermine the judicial recovery process. These factors often result in delays, reduced effectiveness, and increased legal uncertainty within the system.
