The article discusses the balance and effectiveness of the Brazilian reorganization process, highlighting the importance of an economic and financial analysis of companies in crisis for the effectiveness of judicial reorganization. The authors argue that the preservation of business activity, the core of Law No. 11.101/2005, must be accompanied by technical and financial criteria that ensure the viability of the business. They criticize the disconnect between the legal debate and the economic reality of companies undergoing reorganization, proposing greater use of financial indicators and accounting reports in judicial and creditor assessments. They compare the Brazilian system to the North American feasibility test, which requires judicial analysis of the effectiveness of the restructuring plan. They conclude that a more technical and integrated approach between law and economics is necessary to ensure balance, transparency, and credibility in the insolvency system.
