This article examines contractual relationships in the context of the global economy, highlighting the imbalance between contracting parties and the need to rethink the principle of contractual autonomy in light of existing economic and technical disparities. The author, Justice Marco Aurélio Bellizze, analyzes the importance of correction mechanisms, such as objective good faith, the social function of the contract, and regulatory state intervention, to ensure contractual justice and protect vulnerable contracting parties. The text emphasizes the relevance of comparative law and case law in constructing a new contractual paradigm, aimed at harmonizing freedom and solidarity, preserving legal certainty and equity in global economic transactions.
