This article addresses professional secrecy and the inviolability of the practice of law based on an analysis of the decision in Writ of Mandamus (RMS) Appeal n. 67,105, of the Fourth Panel of the Superior Court of Justice (STJ), which recognized confidentiality in legal service contracts. It concludes that, by protecting the attorney-client relationship, the Panel reinforces the importance of the legal profession as an essential function of justice and affirms the Court’s understanding that breaching professional secrecy violates the right to defense, access to justice, and, ultimately, democracy itself.
