Keywords:
Judicial precedents, Legal certainty, Equality, Procedural speedAbstract
This text analyzes the consolidation of the judicial precedent system in Brazil, highlighting its importance for stability, predictability, legal certainty, equality, and procedural speed. It explains the transition from a model based exclusively on persuasive jurisprudence to one that confers binding force on certain decisions, bringing the country closer to the common law tradition without abandoning the foundations of civil law. The work pays tribute to Justice Antonio Carlos Ferreira, whose work was decisive in harmonizing these models and strengthening the coherence and efficiency of the Judiciary. The author emphasizes that the precedent system also functions as a procedural management tool, contributing to the streamlining of the judiciary and reducing litigation.
