Abstract

This article critically analyzes Bill No. 04/2025, which proposes extensive modifications to the Civil Code’s Succession Book. The author points out that many changes compromise legal certainty, introducing vague concepts and inconsistent solutions to sensitive issues such as the succession of spouses and cohabitants, equality between heirs, and the validity of wills. Concerns are highlighted regarding the weakening of the spouse’s succession status, the uncertainty surrounding new testamentary forms, and the imprecision in the regulation of trusts, which unduly resemble the trust model. The conclusion is that the legislative proposals lack technical expertise and coherence, potentially generating more uncertainty than progress in succession law.
