Abstract

This article examines the associated management of public services within the framework of Brazilian cooperative federalism, focusing on public consortium as instruments of intergovernmental cooperation. It explores the normative and jurisprudential developments that have consolidated associated management, highlighting Law No. 11.107/2005 and its regulations, as well as their impact on governance and administrative efficiency. The paper addresses public service concessions within consortium, including legal aspects related to ownership, competence, and the possibility of adding new municipalities to existing contracts, considering the principles of legality, efficiency, and public interest. It concludes that such contractual amendments are legally feasible, even when exceeding the 25% limit established by Law No. 14.133/2021, given the special nature of concessions and public-private partnerships.
