Abstract

Ensuring the predictability of the actions of the
Judiciary is a measure of undeniable importance for legal security and social pacification. The Brazilian precedent system differs greatly from
classical systems. Here, the decision already has the status of precedent, being binding by force of law. Although the decision is considering a specific case, it will be used as a paradigm for resolving other similar cases. There is no break with the civil law system, but there is an undeniable rapprochement with the common law system, even though precedents are treated differently.
This article aims to carry out an analysis of precedents in the Brazilian legal system, focusing on procedural labor law.
