Abstract

This article analyzes the landmark Guanabara Palace case, reported by Justice Antonio Carlos Ferreira in the Superior Court of Justice, which concluded a 123-year dispute between the Union and the heirs of Princess Isabel and Count d’Eu. The controversy revolved around the ownership of the property acquired with imperial dowry funds. The Justice concluded that the dowry was sui generis in nature, granting only the right of use to the imperial family, with ownership remaining with the State since the Empire. The decision reaffirmed the public nature of the Palace and the extinction of birthrights with the Republic, establishing an important precedent regarding national heritage and the end of imperial dowry rights. The study also highlights the legal erudition and technical rigor of the reporting judge.
