Abstract

This paper examines judgments’ evolution regarding the proof of local holidays in Brazilian civil procedure, specifically for the purpose of assessing the (in)timeliness of appeals. It analyzes the back-and-forth developments in the case law of both the Supremo Tribunal Federal (STF) and the Superior Tribunal de Justiça (STJ), under the frameworks of the 1973 and 2015 Codes of Civil Procedure — including the legislative amendment introduced by Law No. 14.939/ 2024. The article also highlights the prominent role played by Justice Antonio Carlos Ferreira in shaping this debate.
