O Superior Tribunal de Justiça e o necessário controle, pela própria Corte, das teses firmadas em recursos repetitivos

This article examines the Superior Tribunal de Justiça (STJ) role in unifying infra-constitutional law through the Recurso Especial repetitivo system. Given Brazil’s mass litigation, the binding precedents established by the 2015 CPC aim to ensure legal certainty and equality. However, a systemic flaw is identified: intermediate courts frequently misapply these theses, while the STJ lacks effective supervisory mechanisms. Current case law (e.g., Rcl 36.476/SP) restricts the use of reclamação, relegating error correction to lower courts. This study argues that such a restriction is contradictory and violates the principles of integrity and coherence (Art. 926, CPC). It concludes that the constitutional complaint, as provided in Art. 988, § 5, II, of the CPC, is the proper instrument for the STJ to supervise precedent application, ensuring a functional and stable precedent system in Brazil.
